Malta Yacht Ownerships

Malta Yacht Ownerships are not limited to Maltese citizens only. Malta's Merchant Shipping Act requires a yacht that flies under the Malta flag to either be owned by:

  • a Maltese citizen under his/her own name
  • corporate bodies established or under Maltese law having their head office of business situated in Malta
  • an EU citizen or entity; or a foreign individual entity by appointing a resident agent

Becoming a Maltese citizen

Becoming a Maltese citizen is obviously one way to be eligible to fly a yacht under the Malta flag. But becoming a Maltese citizen can take some time (4 - 6 months; in difficult cases up to two years) so it might not be the most worthwhile decision if you are just interested in Malta Yacht Ownerships.

Malta Yacht Ownerships through a Maltese Company

Setting up a company in Malta is a simple procedure. In order to set up a company in Malta you need to submit a memorandum and articles of association of the company and any ancillary documents that might be required from the Registry of Companies. Setting up a company through the Malta Financial Services Authority usually takes effect in about 48 hours, unless further proof or documentation is required. Maltese law does not demand any limitation on the nationality of the shareholder in the company and provides four different corporate vehicles including the formation of trusts in order to own and manage a yacht.

Malta Yacht Ownerships by appointing a resident agent

A resident agent is a Maltese citizen who works as the channel of communication between an international owner of a yacht and the Maltese government departments and authorities. He signs and files, on behalf of the international owner, all declarations and forms required in terms of the Maltese law, with Maltese government departments and authorities. As well acting as the judicial representative of the international owner for judicial proceedings in Malta.
