Yacht importation in the EU

Yacht importation in the EU for Non-EU vessels can be done temporarily if the vessel is intended for re-export and used for private purposes, without Value Added Tax (VAT) or customs duties needing to be paid. Therefore the yacht concerned has to be placed under the "temporary importation procedure" (TI) with Customs. This can only be done by persons who are not EU residents. 

If the yacht importation in the EU is done for commercial purposes it has to undergo relative VAT and custom procedures to subsequently be imported into the EU. For a yacht to be placed in the EU indefinitely it would need to be registered in a EU member state, in that case a yacht registration in Malta would be a fiscally advantageous alternative.

Temporary importation procedure

As its name implies this procedure only allows the yacht to sail in EU waters for a limited period of time. After that period the yacht either has to leave or customs duty and VAT become due. Since the yacht is temporarily imported into the EU and not into one of its constituent member states it can be moved to any other member state with no further customs formalities.

In order to be placed under TI a yacht simply has to cross the frontier of the customs territory of the Community. In some cases the provision of a security deposit to cover for the payment of the customs duties and VAT that would become due if the yacht does not leave the EU in the required amount of time must be paid.

Time period for the temporary yacht importation in the EU

The period for discharge for privately used vessels is 18 months. This period may be extended for the time during which the yacht is not used if the vessel is laid up. The maximum overall period for the boat to remain in the EU shall, however, not exceed 24 months in total. Since there is no minimum period during which the yacht has to stay outside of the EU, before it may begin a new period of temporary importation, you can prolong your temporary yacht importation in the EU by leaving and returning to the customs territory of the EU every 18 months.
